These Terms of Use and Conditions (“Terms”) govern your access to and use of the Site and any purchases made through it. By accessing or using the Site, you agree to be bound by these Terms. Hoyer® is a registered trademark of Joerns Healthcare, LLC.

MyHoyerLift.com is an independent authorized dealer of genuine Joerns Healthcare Hoyer® patient lifts and related products.

This website is independently owned and operated and is not affiliated with, sponsored by, or endorsed by Joerns Healthcare, LLC except in its capacity as an authorized dealer.

Some of the images, product photographs, and other visual materials displayed on MyHoyerLift.com are the copyrighted property of Joerns Healthcare, LLC. The Hoyer® name and related marks are trademarks of Joerns Healthcare, LLC. All rights in those trademarks and copyrighted materials remain with Joerns Healthcare, LLC. Use of such materials on this Site is solely in connection with the authorized sale of genuine Hoyer® products.

2. Acceptance of Terms

By visiting the Site, creating an account, placing an order, or otherwise using any services offered through the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

• We are a seller of medical equipment. We do not provide medical advice, diagnosis, or treatment recommendations.
• Patient lifts and related products should only be used under the guidance of a qualified healthcare professional.
• You are solely responsible for ensuring that any product purchased is appropriate for the intended user’s clinical needs, weight capacity, and environment.
• Always follow the manufacturer’s instructions for use, weight limits, and safety guidelines. Improper use can result in serious injury or death.
• We make no warranties or representations regarding clinical outcomes.

5. Orders, Pricing, and Payment

• All prices are listed in U.S. dollars and are subject to change without notice.
• We reserve the right to refuse or cancel any order for any reason, including pricing errors, product availability, or suspected fraud.
• Payment is due at the time of order. We accept major credit cards and other payment methods displayed at checkout.
• Title and risk of loss pass to you upon delivery to the carrier (unless otherwise stated).

6. Shipping and Delivery

Shipping terms, methods, estimated delivery times, and any applicable freight or lift-gate fees will be presented at checkout or in a separate shipping policy. Delivery dates are estimates only. We are not responsible for delays caused by carriers, customs, weather, or other events beyond our reasonable control.

7. Returns, Refunds, and Exchanges

Returns and refunds are governed by our separate Return Policy, which is incorporated into these Terms by reference. Certain products (especially large patient lifts) may be subject to restocking fees, return shipping costs, or restrictions due to size, weight, or hygiene considerations. Manufacturer warranties (if any) on Hoyer® products are provided by Joerns Healthcare, LLC or the applicable manufacturer and are subject to their terms. We do not independently warrant the products beyond any limited warranty we may expressly provide in writing.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GILA INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY PRODUCTS PURCHASED, INCLUDING PERSONAL INJURY OR PROPERTY DAMAGE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Gila Inc. and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your misuse of any products purchased.

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Site shall be resolved exclusively in the state or federal courts located in Los Angeles County, California. You consent to personal jurisdiction in those courts.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
